DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) POLICY

The Gazette News Nigeria Limited (“The Gazette Nigeria”) is an independent media organisation headquartered in Abuja, Federal Capital Territory, Nigeria, with an operating office at 2 K24 Udi Hill Close, Karewa GRA, Jimeta-Yola, Adamawa State. The organisation is committed to respecting the intellectual property rights of others and expects users of its website, ePaper, print editions, and related services to do the same.

This Digital Millennium Copyright Act (DMCA) Policy outlines the procedures for addressing claims of copyright infringement on www.thegazette.com.ng and associated services, in accordance with the DMCA and applicable Nigerian laws, including the Copyright Act 2022.

If you believe that your copyrighted work has been used in a manner that constitutes infringement, or if you have received a notice alleging infringement, please follow the procedures outlined below.

1. DMCA Takedown Notice

To report alleged copyright infringement on The Gazette Nigeria’s services, a written DMCA takedown notice must be submitted to the Designated Agent. The notice must contain the following information:

• A physical or electronic signature of the copyright owner or an authorised representative

• Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved

• Identification of the allegedly infringing material, including a URL or precise location sufficient to allow the material to be located

• Contact information, including name, address, telephone number, and email address

• A statement confirming a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law

• A statement made under penalty of perjury that the information in the notice is accurate and that the complainant is the copyright owner or authorised to act on their behalf

Upon receipt of a valid takedown notice, The Gazette Nigeria will promptly investigate the claim and, where appropriate, remove or disable access to the allegedly infringing material. Where possible, the user responsible for posting the material will be notified and provided with a copy of the notice.

2. Counter-Notice

If material has been removed or disabled as a result of a DMCA takedown notice and the affected party believes the removal was due to mistake or misidentification, a written counter-notice may be submitted to the Designated Agent.

A valid counter-notice must include the following:

• A physical or electronic signature

• Identification of the material that was removed or disabled and the location where it previously appeared

• A statement, under penalty of perjury, that there is a good-faith belief the material was removed or disabled due to mistake or misidentification

• A statement consenting to the jurisdiction of the Federal High Court of Nigeria for the judicial division in which the user resides, or the Federal High Court in Abuja if residing outside Nigeria, and agreeing to accept service of process from the original complainant or their agent

Upon receipt of a valid counter-notice, it will be forwarded to the original complainant. If the complainant does not notify The Gazette Nigeria within ten business days that legal action has been initiated to restrain the alleged infringement, access to the material may be restored at the discretion of The Gazette Nigeria.

3. Repeat Infringer Policy

The Gazette Nigeria maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. The organisation reserves the right to disable or remove access to content posted by users who repeatedly violate intellectual property rights, in accordance with applicable laws and internal discretion.

4. Additional Notes

The Gazette Nigeria processes DMCA notices and counter-notices in good faith and endeavours to act promptly. However, the organisation is not liable for errors, delays, or disputes arising from such submissions.

Submitting false or misleading DMCA notices or counter-notices may result in legal liability under applicable United States or Nigerian law.

In addition to DMCA compliance, The Gazette Nigeria adheres to the Nigerian Copyright Act 2022 and other relevant regulations. Claims submitted under Nigerian law should include comparable details and may be directed to the same Designated Agent.
