The Gazette News Nigeria Limited ("The Gazette Nigeria"), an independent media company headquartered in Abuja, Federal Capital Territory, Nigeria, with an operating office at 2 K24 Udi Hill Close, Karewa GRA, Jimeta-Yola, Adamawa State, is committed to respecting the intellectual property rights of others. This Digital Millennium Copyright Act (DMCA) Policy outlines our procedures for addressing claims of copyright infringement on our website (www.thegazette.com.ng), ePaper, print editions, and related services ("Services") in accordance with the DMCA and applicable Nigerian laws, including the Copyright Act 2022.
If you believe that your copyrighted work has been used or reproduced on our Services in a way that constitutes copyright infringement, or if you have received a notice of alleged infringement, please follow the procedures below.
1. DMCA Takedown Notice
To report alleged copyright infringement on our Services, you must submit a written DMCA takedown notice to our Designated Agent. The notice must include all of the following information, as required by 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are involved, a representative list of such works.
- Identification of the material that is claimed to be infringing, including a URL or specific location on our Services where the material can be found, with sufficient detail to allow us to locate it.
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

- Identification of the material that was removed or disabled, including the URL or location where it appeared on our Services.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the Federal High Court of Nigeria for the judicial division in which your address is located (or the Federal High Court in Abuja if your address is outside Nigeria), and that you will accept service of process from the person who filed the original takedown notice or their agent.

- Good Faith Compliance: The Gazette Nigeria acts in good faith to process DMCA notices and counter-notices promptly. However, we are not liable for any errors, delays, or disputes arising from such notices.
- Misrepresentations: Submitting a false or misleading DMCA notice or counter-notice may result in legal liability under 17 U.S.C. § 512(f) or Nigerian law. Please ensure all claims are accurate and substantiated.
- Nigerian Copyright Law: In addition to the DMCA, we comply with the Nigerian Copyright Act 2022 and other relevant regulations. Claims under Nigerian law should include similar details as required for DMCA notices and may be submitted to the same Designated Agent.

Upon receipt of a valid takedown notice, we will promptly investigate and, if appropriate, remove or disable access to the allegedly infringing material. We will also notify the user who posted the material, if identifiable, and provide them with a copy of the notice.
2. Counter-Notice
If you believe that material you posted was removed or disabled as a result of a DMCA takedown notice in error or misidentification, you may submit a written counter-notice to our Designated Agent. The counter-notice must include all of the following, as required by 17 U.S.C. § 512(g)(3):

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a legal action to restrain the allegedly infringing activity, we may, at our discretion, restore or re-enable access to the material. We are not obligated to restore material if we believe it infringes copyright or violates our Terms and Conditions.
3. Repeat Infringer Policy
The Gazette Nigeria has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We reserve the right to disable or remove access to material posted by users who repeatedly violate the intellectual property rights of others, as determined in our sole discretion and in accordance with applicable laws.
